General Information
emaitza ("we," "us," or "our") is operated by Maite Lanzagorta, a sole proprietor (raison individuelle) based in Geneva, Switzerland, at the software interface https://emaitza.com. We are committed to protecting your personal data in accordance with the Swiss Federal Act on Data Protection (revised FADP / nFADP), and — where applicable to users in the European Union — the General Data Protection Regulation (GDPR).
This policy explains what data we collect, why, and your rights. It applies to two groups: professionals who create a emaitza profile to receive cashless tips, and tippers who leave a tip and optional review.
Data We Collect From Professionals
Account data: Your name and email address, collected when you create your profile, used for authentication and account management. Authentication and account data are managed through our infrastructure and authentication provider.
Profile data: Your display name, profession, profile photo, and the unique profile link (slug) you use to receive tips.
Transactional metadata: Records of tips you receive (amounts, dates, platform fees, status) displayed on your dashboard. We do not store your full card or bank details — those are held by our payment provider.
Payout connection: When you connect a payout account, your identity verification and bank details are collected and held directly by Stripe, not by emaitza.
Data We Collect From Tippers
Tip data: The tip amount and the payment, processed entirely by Stripe. emaitza does not store your card details.
Review data: Leaving a review is part of the tipping flow. When you tip, you provide the first name you enter, a star rating, and a review message.
Public display: Please note that your first name (shown in shortened form, e.g. "Marco A."), star rating, and review message are displayed publicly on the professional's emaitza profile page. Do not include private or sensitive information in your review message. You may request removal of a published review by contacting us (see Section 8).
Technical Data
We currently do not use any website analytics or tracking cookies. If we introduce analytics in the future, we will use a privacy-first, cookieless provider and update this policy accordingly before doing so.
How We Use Your Data
We process personal data only to:
Provide, operate, and maintain the emaitza service;
Process tips and display transaction records;
Display professional profiles and verified reviews;
Communicate with you about your account and service-related matters;
Comply with our legal obligations.
Third-Party Service Providers
We rely on a small number of specialized providers to operate the service:
Payment processing: Stripe Payments Europe, Ltd. processes all tips and holds all payment and payout data. emaitza never receives or holds tip funds. (We name Stripe specifically because you interact with it directly when paying or connecting a payout account.)
Infrastructure & authentication: Our database and account authentication are handled by a specialized infrastructure provider, hosted in the European Union (Ireland).
These providers process data only as necessary to deliver their service to us. A current, named list of sub-processors is available to registered users on request at hello@emaitza.com.
International Data Transfers
Some of our providers operate or store data outside Switzerland, including in the European Union and the United States. Where data is transferred to the United States, we rely on the provider's certification under the Swiss–U.S. Data Privacy Framework where applicable, or on Standard Contractual Clauses (SCCs) to ensure a level of protection equivalent to Swiss and EU law.
Your Rights
You have the right to access, correct, delete, or request a copy of your personal data, and to object to or restrict certain processing. Tippers may request removal of a published review. To exercise any of these rights, contact us at hello@emaitza.com. We will respond within the timeframes required by applicable law.
Communications and Consent
We distinguish between two types of messages:
Service messages (transactional): notifications about your account, tips received, sign-up completion, security, and support. These are necessary to provide the service and are sent on the basis of our contractual relationship with you.
Marketing messages (optional): product updates, tips on growing your earnings, and promotional content. We send these only if you have explicitly opted in. You can withdraw your consent at any time, with no effect on the service messages above.
Data Retention
We retain account and transaction data for as long as your account is active and as required to meet legal, accounting, and tax obligations. When you delete your account, we remove or anonymize your personal data except where retention is legally required.
Changes to This Policy
We may update this policy from time to time. If we make material changes, we will notify registered users and update the "Last Updated" date above.
