1. Contractual Relationship

These Terms of Service ("Terms") govern your access to and use of the applications, websites, content, and services (the "Services") made available by emaitza, operated by Maite Lanzagorta, a sole proprietor based in Geneva, Switzerland ("emaitza," "we," "us"). By using the Services, you agree to these Terms.

These Terms apply both to professionals who create a profile to receive tips and to tippers who leave a tip or review.

2. The Services (Software Only)

emaitza provides a software interface that lets service professionals receive cashless tips and display reviews, and lets clients leave a tip and optional review. emaitza is a software provider — not a bank, money transmitter, payment processor, or financial intermediary. emaitza facilitates a connection to a third-party payment provider but does not itself provide payment services.

3. Payment Processing via Stripe

All payment processing is provided by Stripe Payments Europe, Ltd. ("Stripe") and is subject to the Stripe Connected Account Agreement and the Stripe Services Agreement.

  • By using emaitza, you agree to be bound by the applicable Stripe agreements.

  • emaitza does not at any point hold, receive, manage, or take possession of any funds. When a tipper pays, the funds are collected directly into the professional's own Stripe account. emaitza never receives the money; we only collect our service fee.

  • Any dispute regarding the movement of money, withheld balances, payouts, or transaction failures must be resolved directly with Stripe.

4. Fees

emaitza charges a platform service fee on each tip, collected automatically through Stripe at the time of the tip. The fee is added on top of the tip amount and paid by the tipper, so the professional receives the full tip amount they were sent.

The current fee structure is:

  • Minimum tip amount: CHF 5

  • Tips up to and including CHF 10: flat fee of CHF 1

  • Tips above CHF 10: 8% of the tip amount

Current fees and any plan-based pricing (such as the Elite subscription) are shown on our Pricing page, which forms part of these Terms. We may update the fee structure from time to time; changes apply to tips made after the change takes effect.

5. Tips and Reviews

  • Tips made through emaitza are voluntary and final. By confirming a tip, the tipper authorizes the charge of the tip amount plus the platform fee to their chosen payment method.

  • Leaving a star rating and a written review is part of the tipping flow. By submitting a tip, the tipper provides a first name, a star rating, and a review message, and grants emaitza and the relevant professional the right to display that review publicly on the professional's emaitza profile (the first name is shown in shortened form, e.g. "Marco A.").

  • Because funds are transferred directly to the professional, refund requests must be directed to Stripe and/or the professional. emaitza cannot reverse a tip, as it never holds the funds.

6. Reviews and User Content

  • Reviews are submitted as part of each tip (see Section 5). By submitting a review, you grant emaitza and the relevant professional the right to display that review (your first name in shortened form, your rating, and your message) publicly on the professional's emaitza profile.

  • You are responsible for the content you submit. Do not submit unlawful, defamatory, abusive, misleading, or privacy-infringing content, and do not include sensitive personal information.

  • Professionals may not fabricate, solicit in exchange for compensation, or otherwise manipulate reviews. Only reviews tied to a completed tip are displayed as verified.

  • emaitza may remove any review or content that violates these Terms or applicable law, and will act on legitimate removal requests.

7. User Obligations

You agree to use the Services only for lawful purposes. You may not use the Services for any fraudulent activity or in any way that violates the Stripe Prohibited and Restricted Businesses policy. Professionals are responsible for declaring and paying any taxes due on tips they receive.

8. Liability Disclaimer

To the maximum extent permitted by Swiss law, emaitza shall not be liable for:

  • Technical malfunctions, outages, or errors originating from Stripe's infrastructure or other third-party providers;

  • Loss of profits, data, or business opportunities arising from your use of the software;

  • Indirect or consequential damages arising from the Services.

Nothing in these Terms excludes liability that cannot be excluded under mandatory Swiss law.

9. Intellectual Property

The emaitza brand, software, code, and design are the exclusive property of Maite Lanzagorta. You are granted a limited, non-exclusive, non-transferable license to use the interface for its intended purpose. Content you submit (such as reviews) remains yours, subject to the display license granted in Section 6.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of Switzerland. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of the Canton of Geneva, subject to any mandatory consumer-protection rules that grant consumers the right to bring proceedings in their place of residence.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting a notice on the site or notifying registered users — before the changes take effect. Your continued use of the Services after changes take effect indicates acceptance of the revised Terms.
